A new short article about being exempt from overtime in California

I am of the opinion that a fairly high percentage of California employees are improperly classified by their employers as exempt from overtime laws.

In my 14 years or so of experience in the employment and labor field, I have found employers will try to get away with paying an employee a salary and working them more than 8 hours in a day, or 40 hours in a week, without paying overtime. If the employee has an office job, he or she often views himself or herself as a "professional" and then doesn't question their employer's payment practices.

The way the law is structured, if an employee's position is on the margin of being exempt from overtime, an employer has an incentive to misclassify the employee as a salary employee and not pay them overtime, because if an employer gets caught, there is not a sufficient consequence or penalty, they basically just have to pay what the employee is owed.

I strongly believe in educating the workforce on their rights around these issues. If the wage and hour laws were described in a more simple manner, then employees would understand their rights and demand them from their employers. So, I'm always on the lookout for an article that simply describes the law. I found one today that is not too bad. Check it out:
